1) Agreement to terms

By accessing or using HoopsResults (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2) The Service

HoopsResults provides NCAA basketball scoreboard information and allows you to track games/teams/conferences and receive email digests. The Service may be offered as a “Beta” and may change frequently.

3) Eligibility

You must be at least 13 years old to use the Service.

4) Accounts and security

• You are responsible for safeguarding your credentials and for activity under your account.
• You agree to provide accurate information and keep it updated.
• We may require email verification before enabling certain features.

5) Acceptable use

You agree not to:

• Access or attempt to access non-public areas of the Service.
• Interfere with or disrupt the Service (including abuse of APIs or excessive automated requests).
• Use the Service for unlawful, infringing, or harmful activities.
• Reverse engineer the Service except to the extent permitted by law.

6) Emails

You may receive transactional emails (verification, password reset) and, if enabled, digest emails. Email delivery can be delayed or filtered and is not guaranteed.

7) Third-party services and content

The Service may rely on third-party services (e.g., email delivery) and may display or link to third-party content. We do not control third-party services and are not responsible for their availability or practices. NCAA names/logos/trademarks belong to their respective owners; HoopsResults is not affiliated with or endorsed by the NCAA.

8) Intellectual property

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or internal business use, subject to these Terms.

9) Feedback

If you provide feedback, you grant us the right to use it without restriction or compensation.

10) Suspension and termination

We may suspend or terminate access if we reasonably believe you violated these Terms, pose a security risk, or we must do so to comply with law. You may stop using the Service at any time and can delete your account via settings.

11) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that game/digest data will be accurate or complete.

12) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ndukt limited BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED $100.

13) Indemnification

You agree to indemnify and hold harmless ndukt limited from claims arising out of your use of the Service or violation of these Terms.

14) Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. You agree that any dispute will be brought in the state or federal courts located in Colorado, and you consent to personal jurisdiction and venue there.

15) Changes

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.
